In consideration of you accepting this entry, I, the participant, intending to be legally bound do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against the Event Director, RunSignup.com, and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.

WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
HEARTBEAT FOR JESUS 40-DAY TRAINING PLAN & 5K RACE

This Waiver of Liability, Assumption of Risk, and Indemnity Agreement (the "Agreement") is executed by the undersigned participant ("Participant") in favor of Heartbeat for Jesus, Inc. ("Organization"), its officers, directors, employees, agents, affiliates, sponsors, volunteers, event coordinators, and any other parties involved in organizing or supporting the 40-Day Training Plan and the Heartbeat for Jesus 5K event ("Event").

1. ASSUMPTION OF RISK
I understand that participating in a structured physical training program and a 5K race involves inherent risks, including but not limited to falls, collisions, overexertion, dehydration, heart complications, muscle and joint injuries, heat-related illnesses, exposure to weather conditions, and any other risks associated with physical activity. I voluntarily assume full responsibility for any and all risks, known or unknown, associated with my participation in the training program and the Event.

2. RELEASE AND WAIVER OF LIABILITY:
I hereby release, discharge, and hold harmless the Organization and all related parties from any and all liability, claims, demands, actions, or causes of action related to any loss, damage, injury, illness, or death that may result from my participation in the 40-Day Training Plan and Event. This release includes, but is not limited to, claims based on negligence, gross negligence, or any other legal theory of liability, except for intentional misconduct or recklessness.

3. MEDICAL CONSENT AND FITNESS TO PARTICIPATE:
I affirm that I am in good physical condition and have consulted a physician regarding my ability to participate in this training program and Event. I acknowledge that I am solely responsible for monitoring my health and fitness during the training and race. In the event of an emergency, I authorize medical personnel to provide necessary treatment, and I accept full responsibility for any associated costs.

4. INDEMNIFICATION:
I agree to indemnify and hold harmless the Organization from any and all liabilities, costs, damages, and expenses (including reasonable attorney’s fees) arising from my participation in the training program and Event, including claims brought by third parties due to my actions or negligence.

5. PHOTO AND MEDIA RELEASE
I grant the Organization permission to use my name, image, likeness, and any photographs, videos, or media taken during my participation in the training program and Event for promotional, educational, or informational purposes without compensation or restriction.

6. SEVERABILITY: 
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

7. ACKNOWLEDGEMENT AND AGREEMENT
I acknowledge that I have read and understand this Agreement, and I voluntarily sign it, intending to be legally bound. I understand that I am waiving substantial legal rights, including my ability to sue the Organization for any injury or loss sustained as a result of my participation in the 40-Day Training Plan and Event.

Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.

This event follows the standard running industry policy: All entry fees are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable and bib numbers are non transferable.

By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver including the no refund policy.
