By submitting this Application, you confirm that you have read, agree to, and have signed on behalf of yourself and/or your children who are participating in the Events as defined below (the “Participant”) the following Waiver and Release dated as of the date your Application is submitted.
In exchange for the acceptance of this Application, Participant hereby agrees to participate in The Vinings Down Hill 5K Run for the Kids 5K Run, Kids 1K Fun Run, or Doggie Dash & Costume Contest (collectively referred to as the “Events”) sponsored by the Rotary Club of Vinings Cumberland or Vinings Cumberland Rotary Charity Fund (hereinafter “the Rotary Club”) with complete understanding of the risks associated with participation in the Events and subject to the terms and conditions of this Waiver and Release Agreement.
Participant fully understands that training for, attending, and participating in the Events may result in accident, illness, or serious personal or property injury or damage and assumes the risk and will be solely liable for any and all claims, costs, injuries, or damages (up to and including serious bodily harm or death), including reasonable attorneys’ fees, that may result from or be associated or connected with the Participant’s participation in the Events.
I further acknowledge that the Events require participants to be in proper physical condition. Participant declares that he/she/they are medically able, properly trained, physically fit, and capable of participating in the Events.
In consideration for being allowed to participate in any or all of the Events, Participant further agrees not to sue and to release and hold harmless the premises owners and the Events’ sponsors, including but not limited to the Rotary Club, their affiliates, agents, officers, directors, members, volunteers, and employees, from any and all liability for any claims, costs, damages, injuries and/or illnesses, including serious bodily injury and death, that may directly or indirectly result from Participant’s negligence or from the negligence of other participants in the Events, and/or from the negligence of the premises owners or the negligence of the sponsors of the Events, including but not limited to the Rotary Club, their affiliates, agents, officers, directors, members, volunteers, and employees.
Participant understands and agrees that this Waiver and Release is legally binding on Participant and his, her, or their heirs, successors or assigns under the laws of Georgia.
In the event of an illness, injury or medical emergency arising during the event, Participant hereby authorizes and gives consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. Participant agrees that he, she, they will be fully responsible for payment of any and all medical services and treatment rendered, including but not limited to medical transport, medications, treatment and hospitalization.
Participant hereby grants consent and permission to the Rotary Club, its affiliates, agents, officers, directors, members, volunteers, and employees, to use his, her, or their name, photograph, videotape, motion picture recording, voice, or likeness for Rotary purposes, including pre- and post- event publicity and social media.
The Events follow the standard running industry policy, as follows, All entry fees are non-refundable. The Rotary Club reserves the right to postpone or cancel the Events due to circumstances beyond its control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. The Rotary Club reserves the right to change the details of the Events without prior notice. Participant understands that the entry fee is nonrefundable and bib numbers are non-transferable.
Participant has carefully read this Waiver and Release and fully understands its contents. Participant consents and agrees to the terms of this Waiver and Release.
