Landon’s Light Memorial Mountain Bike Race
Amateur Athletic Waiver and Release of Liability
In consideration of being allowed to participate in any way in the LANDON’S LIGHT MEMORIAL MOUNTAIN BIKE RACE, its related events and activities, I, the undersigned, acknowledge, appreciate, and agree that:
1. The risk of injury from the activities involved in a mountain biking program is significant, including the potential for permanent paralysis and death, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist. I acknowledge all such risks are known, inherent, and understood.
2. I understand and agree that the inherent risks of mountain biking include those dangers or conditions that are characteristic of, intrinsic to, or an integral part of mountain biking and that such risks cannot be prevented by the use of reasonable care. The inherent risks of mountain biking include, but are not limited to: exposed rock, earth, ice or other natural objects; trees, tree wells, tree stumps, forest deadfall; holes and depressions on or beneath the trail or surface; variable and difficult weather conditions (including, but not limited to rain, hail, snow, wind and lightning); changes or variations in the terrain which may create blind spots or areas of reduced visibility; streams and creeks; cliffs; crevasses; travel on back-country roads; snowcat roads, road-banks and cut-banks; impact or collision with other mountain bikes and vehicles, becoming lost or separated from the coaches or other participants; mechanical failure of mountain bikes and related equipment; extreme and rapidly changing weather conditions; encounter with wildlife including bears; avalanches; the failure to operate a mountain bike safely or within one's own ability; negligence of other mountain bikers and other persons.
3. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation and waive any and all claims which I might have based on any of those and other risks typically found in participating in mountain biking; and,
4. I certify that my fitness and health is sufficient for participation; and,
5. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release, indemnify, and hold harmless LANDON’S LIGHT, LLC, the City of Bozeman, Bozeman Health, Gallatin Valley Land Trust, Gallatin County, Muddy Dog Timing, runsignup.com, other participants, volunteers, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the activity ("Releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property associated with my presence or participation, WHETHER ARISING FROM THE
NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
By signing this document you may be waiving your legal right to a jury trial to hold the provider legally responsible for any injuries or damages resulting from risks inherent in the sport or recreational opportunity or for any injuries or damages you may suffer due to the provider's ordinary negligence that are the result of the provider's failure to exercise reasonable care.
In the event of an illness, injury or medical emergency arising, I hereby authorize and give my consent to LANDON’S LIGHT, LLC employees, officers, representatives and volunteers for immediate treatment and then to secure from any accredited hospital, clinic and/or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including, but not limited to, medical transport, medications, treatment and hospitalization.
Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, video graphic or electronic recording for legitimate purposes.
PARTICIPANT'S SIGNATURE OR PARENT/LEGAL GUARDIAN OF PARTICIPANTS OF MINORITY AGE
This is to certify that I, representing myself, and/or as the parent/legal guardian with legal responsibility for this participant, do consent and agree to the release as provided above of all the Releasees, and, for myself, my child and our heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to mine and/or my minor child's involvement or participation in the LANDON’S LIGHT MEMORIAL MOUNTAIN BIKE RACE as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law.
By signing this entry, I acknowledge having read and agreed to the above release and waiver.
