MOTHERS AGAINST DRUNK DRIVING (“MADD”) PARTICIPANT WAIVER AND RELEASE (“Waiver and Release”) FOR ALL MADD EVENTS I AGREE THAT ANY AND ALL REPRESENTATIONS MADE AND RELEASES, WAIVERS, COVENANTS, CONSENTS AND PERMISSIONS GIVEN BY ME HEREUNDER ARE GIVEN ON BEHALF OF MYSELF AND THAT OF MY MINOR CHILD(REN), IF UNDER THE AGE OF 18 YEARS OF AGE, AND THOSE OTHER PEOPLE I AM AUTHORIZED TO REGSITER TO PARTICIPATE ON THEIR BEHALF. Acknowledgement and Waiver of Liability/Assumption of Risk I hereby acknowledge, agree and understand that all MOVE WITH MADD events including, but not limited to, all 5k walks and runs, MADD races, MADD tournaments and adventures of any kind (i.e., golfing, fishing, bicycling, motorcycling, fire truck or tractor pulls), and any other MADD fundraising events (each a “MADD Event” and collectively, the “MADD Events”) involves physical activities such as walking, running and, in some instances, golfing, fishing, swimming, diving, cycling, motorcycling, playing/interacting with or around sports apparatuses, playing/interacting with or around animals, pulling fire trucks or other large equipment apparatuses, and other contact sports – all activities that may include risks such as, but not limited to, falls, crashes, interaction with other participants (including the potential transfer of communicable viruses and diseases between participants), effects of weather, traffic, and conditions of roads, land, fairways, courts, fields and waterways. I further understand that MADD is not responsible for any loss, damage, or theft of personal belongings which may occur as a result of my participation in the MADD Event. In consideration of participation in the MADD Event, I agree, for myself, and my minor child(ren), and next of kin, my heirs, executors and administrators, to not sue and to release, indemnify and hold harmless MADD, its affiliates, officers, directors, administrators, representatives, past and present employees, volunteers, agents, other participants, all city and state governments, assigns, vendors, venues, contractors, licensees, sponsors, and their representatives and successors and other persons (collectively, the “Releasees”), from any and all liabilities, claims, actions, demands, damages, expenses, attorneys’ fees, and causes of action whatsoever, arising out of my and/or my minor child(ren)’s participation in and/or attendance at the MADD Event and any related activities, whether it results from the negligence of any of the above or from any other cause. I understand that the nature of my and/or my minor child(ren)’s activities relating to the MADD Event may involve physical activity, contact with unidentified or unfamiliar persons or other potential risk of bodily injury or damage to property and I, and on behalf of my minor child(ren), hereby voluntarily assume full and complete responsibility for, and the risk of, any injury (including death), accident or lost/stolen property which may occur during the MADD Event. I attest that I, and/or my minor child(ren), am medically and physically able to participate in the MADD Event and that I, and on behalf of my minor child(ren), am solely responsible for my own health and safety. If I have any doubt as to my, or my minor child(ren)’s ability to successfully and safely participate in and/or complete the MADD Event, I take full responsibility for consulting a physician. I consent to emergency medical care and transportation in the event of injury to me or my minor child(ren) as medical professionals may deem appropriate. This Waiver and Release extends to any liability arising out of or in any way connected with the medical treatment and transportation provided in the event of an emergency, including, but not limited to, negligence emergency rescue operations. Image/Recording/Results Release I give the Releasees the irrevocable right to use, for any purpose whatsoever, wherever, whenever and without compensation, in part or in whole, (i) any photographs, videotapes, audiotapes, and other recordings of me or my minor child(ren) that are made during the course of the MADD Event and any original material created by me in connection with the MADD Event; and (ii) the results of my and/or minor child(ren)’s participation in the MADD Event. Without limiting the foregoing, I agree that all personal information provided by me in connection with the MADD Event may be used by MADD in accordance with its privacy policy found at https://madd.org/privacy-policy/. Miscellaneous This Waiver and Release shall be as broad and inclusive as is permitted by the state or province in which the MADD Event is conducted. In the event any provision of this Waiver and Release is deemed unenforceable by law, (i) MADD shall have the right to modify such provision to the extent necessary to be deemed enforceable; and (ii) all other provisions of this Waiver and Release shall remain in full force and effect. I understand that all donations made in connection with the MADD Event are non-refundable and non-transferable, even if I do not participate in the MADD Event. I also understand that any registration fee associated with the MADD Event is non-refundable, non-transferable, and not tax deductible. I understand that I have given up substantial rights by accepting this Waiver and Release and have signed it freely and voluntarily without any inducement, assurance or guarantee being made to me and intend my acceptance to be a complete and unconditional release of liability to the greatest extent allowed by law. If registering another person other than myself or that of my child(ren) to participate in the MADD Event, I do so with the permission and/or authority given to me from that other person and by registering that other person to participate, they also agree to the terms and conditions of this Waiver and Release. I hereby agree and warrant that I have given a copy of this Waiver and Release to the person I registered for on their behalf. I have read and agree with the statements above. In the event that my minor child(ren) is participating in the MADD event, I hereby attest that I am his/her parent or legal guardian, and that I have the authority to sign this Waiver and Release on his/her behalf. I also attest to having the authority to sign this Waiver and Release on behalf of any other person I may register for on their behalf to participate in a MADD Event.
