In consideration of being permitted to participate in the guided running vacation organized by Rochester Running Company Inc. and/or Robinhood Racing LLC (collectively, the “Organizers”), I agree to the following terms and conditions:
1. ACKNOWLEDGEMENT OF RISK
I understand that participating in a running vacation through mountainous terrain, including but not limited to the Dolomites and Mont Blanc, involves inherent risks. These risks include, but are not limited to:
Trips, falls, or collisions
Sudden changes in weather
Altitude sickness or dehydration
Animal encounters or insect bites
Rockfall or landslides
Navigational errors
Physical exertion or heart-related incidents
Delays, cancellations, or travel-related issues
I acknowledge that these and other unknown or unanticipated risks could result in serious injury, illness, emotional distress, property damage, or death.
2. WAIVER & RELEASE OF LIABILITY
I hereby voluntarily waive, release, and discharge any and all claims for damages for personal injury, death, or property damage which I may have, or which may hereafter accrue to me, as a result of participation in this trip.
This release is intended to discharge, in advance, and to the fullest extent permitted by law, the following parties from any and all liability:
Rochester Running Company Inc.
Robinhood Racing LLC
All affiliated employees, contractors, volunteers, and guides (collectively, “Trip Guides”)
I agree that none of these parties shall be liable or responsible in any way for any injury, death, or loss of property that may occur as a result of my participation in this activity, regardless of whether it arises from negligence, accident, or otherwise.
3. MEDICAL FITNESS & INSURANCE
I certify that I am physically fit, have adequately trained for this event, and have not been advised otherwise by a qualified medical professional. I understand it is my sole responsibility to obtain appropriate travel and medical insurance that covers high-altitude running, evacuation, and repatriation.
4. PERSONAL RESPONSIBILITY
I agree to follow all instructions from guides, comply with local laws and customs, and exercise reasonable care. I accept full responsibility for my conduct, decisions, and actions during the trip.
5. PHOTO RELEASE
I grant permission for the Organizers and Trip Guides to take photographs or videos of me during the trip and to use them for promotional purposes without compensation.
6. GOVERNING LAW & SEVERABILITY
This agreement shall be governed by and construed under the laws of the State of New York. If any portion of this waiver is found to be invalid, the remainder shall remain in full force and effect.
I HAVE READ AND UNDERSTOOD THIS WAIVER AND RELEASE OF LIABILITY. I VOLUNTARILY AGREE TO ITS TERMS.
